As Criminal Chief at the US Attorney’s Office for the Eastern District of Michigan, Michael Martin holds a senior leadership role overseeing federal criminal prosecutions. His record raises serious concerns about whether he would bring the independence, fairness, and impartiality required for a lifetime appointment to the federal bench. Reports of politically influenced decision-making within his office, including actions related to enforcement of the Freedom of Access to Clinic Entrances (FACE) Act, have surfaced alongside broader controversies involving prosecutorial decisions following the killing of Renee Good and Alex Pretti. Taken together, these concerns call into question his ability to serve as an impartial federal judge committed to equal justice under the law.

Judicial Independence

During his Senate confirmation hearing, Michael Martin declined to give direct answers to several questions about the 2020 presidential election and other issues concerning the rule of law, prompting concerns about his ability to serve as an independent and impartial judge.

Reproductive Freedom

As Criminal Chief of the US Attorney’s Office for the Eastern District of Michigan, Michael Martin held a senior leadership role overseeing federal criminal prosecutions, including enforcement of the Freedom of Access to Clinic Entrances (FACE) Act, which protects patients and providers from threats, obstruction, and violence at reproductive health care facilities. Following the 2024 convictions of anti-abortion activists for violating the FACE Act, the Department of Justice dismissed the prosecutors who led the case. Martin, who oversaw the Criminal Division, was in a position that would have required approval of those personnel decisions, raising concerns about his commitment to enforcing federal protections for access to reproductive health care.

Education and Career Highlights: 

Mr. Martin received his JD from Boston College School of Law. He is currently the Criminal Chief for the US attorney’s office for the Eastern District of Michigan. Prior to this role, he was head of the office’s National Security Unit and served as Deputy Criminal Chief and Executive Assistant United States Attorney. He started as an attorney in the Counterespionage Section within the Department of Justice’s National Security Division and, before law school, served as a CIA analyst.
